Trade Leisure Products Ltd T/A Trade Leisure (The Broker)

Terms and Conditions for Selling Motorhomes via our Brokerage Service. 
These Terms and Conditions govern the relationship between Trade Leisure Products Ltd (“we,” “us,” “our”) and the client (“you,” “your”) regarding the sale of motorhomes and campervans through our brokerage services. By engaging our services, you agree to these Terms and Conditions.
Please read these terms and ensure that they are complete and accurate before entering into an agreement. If you have any questions about the agreement or these terms please contact us and we will be happy to answer any questions. These Terms apply to the exclusion of any other terms that you seek to impose or incorporate, or which are implied by trade, custom, practice or course of dealing.

1. Services Provided
1.1. We act as an intermediary to facilitate the sale of your motorhome to potential buyers.
1.2. Our services include:
• Advertising the motorhome on relevant platforms.
• Negotiating with potential buyers on your behalf.
• Managing enquiries and facilitating viewings or inspections.

2. Client Obligations
2.1. You warrant that:
• You are the legal owner of the motorhome or have full authority to sell it.
• The motorhome is free from any liens, charges, finance, or third-party claims unless disclosed to us.
2.2. You will provide accurate and complete information about the motorhome, including but not limited to:
• Make, model, year, mileage, service history, and any faults or defects.
2.3. You agree to make the motorhome available for inspections, viewings, or test drives as necessary.

3. Fees and Commission
3.1. We work on a no sale no fee basis. We charge a commission fee which is a percentage of the selling price and payable upon the successful sale of your motorhome.
3.2. Additional costs, if any, (e.g inspections, or certifications) will be agreed upon in advance.
3.3. Payment of our fee is due immediately on completion of a sale. We will ask the buyer for a deposit to be paid directly to us. If the buyer’s deposit does not cover our fee then you agree to make up the short fall immediately by bank transfer on completion of the sale. The buyer will take possession of the motorhome only when cleared payment is in your bank account.

4. Sale Process
4.1. We will communicate offers to you and seek your approval before finalising a sale.
4.2. The final sale price is subject to your approval.
4.3. Once an agreement is reached, we will facilitate the transfer of ownership and funds between you and the buyer as stated in section 3.3

5. Disclaimers and Limitation of Liability
5.1. We do not guarantee a retail sale of your motorhome or any specific sale price.
5.2. We are not responsible for:
• Any inaccuracies in the information you provide.
• Damage, theft, or loss of the motorhome during the sale process unless caused by our negligence.
5.3. We are not liable for any disputes between you and the buyer post-sale.
5.4 Neither the Broker nor their directors, employees or other agents shall be liable for direct or indirect inconsequential losses of any kind including loss of profits and other forms of expenses and compensation.

6. Cancellation
6.1. The agreement will remain in force for a minimum of 90 days. The agreement can be cancelled with 30 days written notice after the first 60 days.
6.2. The Agreement will continue to be in force thereafter until either a sale is completed, or the agreement is cancelled.
6.3 The Agreement gives the Broker the exclusive rights to sell the motorhome for the term of the Agreement. If any sale is agreed whilst these terms are in force our commission becomes due and payable, regardless of whom the buyer is or whether or not the Broker introduced the buyer to you. If you sell the Motorhome during the term of this agreement without the assistance of the Broker, a sold out of trust fee will become due and payable by you to the Broker. Such fee will be a sum equivalent to our agreed commission fee.

7. Data Protection
7.1. We will process your personal data in accordance with the Data Protection Act 2018 and the UK GDPR.
7.2. Your data will be used solely for the purposes of facilitating the sale of your motorhome.

8. Governing Law
8.1. These Terms and Conditions are governed by the laws of England and Wales.
8.2. Any disputes will be subject to the exclusive jurisdiction of the English courts.

9. Entire Agreement
9.1. These Terms and Conditions constitute the entire agreement between you and us regarding the sale of the motorhome.
9.2. Any amendments must be made in writing and agreed upon by both parties.

10. Acceptance of Terms
By signing this agreement or engaging our services, you confirm that you have read, understood, and agreed to these Terms and Conditions.
